Please read and accept our terms and conditions of booking a holiday or workshop with Digital Photography Holidays, trading as Stephen Studd Photography.
Once this is ticked as accepted and sent we will issue your receipt of payment, an Information PDF about the holiday and the itinerary in PDF format.


Terms & Conditions of Booking.

By making a booking with Digital Photography Holidays Limited, trading as Stephen Studd Photography, you accept the terms and conditions of booking a holiday or workshop with us as outlined below;

The following booking conditions together with the general information contained here, form the basis of your contract of booking with Digital Photography Holidays, trading as Stephen Studd Photography.

As you read these terms and conditions, please note that:
"We", "our" "ourselves" and "us" means Digital Photography Holidays Limited, trading as Stephen Studd Photography.
"You", "your" and "yourself"  "client" "guest" "themselves" "others" means any person

0.1 Booking: If we accept your booking we will issue a confirmation invoice. A contract will then exist between us from the date we issue the confirmation invoice or if you book within 7 days of departure the contract will exist when we accept your deposit. Please refer to your booking confirmation invoice for details regarding final balance payments. 

1. Deposit
a)  A non-refundable deposit is a requirement to secure a place on any of our photography tours or workshops. The amount of the deposit varies according to the holiday or workshop being booked.

b) After payment of the deposit by yourself or on behalf of others, the receipt of a deposit does not imply acceptance of a booking from us. Once the deposit has been paid we require that the online form (above) be filled out accepting our terms and conditions; with your name and email address filled in and the box stating, I accept the terms and conditions of booking, is ticked, we will store and use information that we receive about you or other members of your party for the purposes of booking a holiday(s) or workshop(s). We will not supply your information to any 3rd parties. We regret that we are unable to accept your booking if you do not agree to our terms and conditions of booking and storing your data (which will only be stored until the holiday/workshop ends). When a booking is made on a holiday where we accept a non photographer partner on the booking page, the deposit for the non photographer partner has to be made at the time of the photographer booking. We will confirm our acceptance of your booking after receiving the requested information in writing by email, you will be sent a receipt by email, it is only at this time when we send out this confirmation to you that a binding contract comes into existence between yourself and Digital Photography Holidays, trading as Stephen Studd Photography which will incorporate all our terms and conditions. Any deposit paid to us to secure your place is non-refundable and non-transferable. (see section 4: Cancellation below)       

2. Balance Payment
a i.) The balance payment for the holiday is due 12 weeks prior to the departure date of your chosen holiday, an email reminder will be sent to you with the balance due by date. If Digital Photography Holidays fail to receive the balance payment on the due date we reserve the right to cancel this booking and retain the deposit payment. If a booking is made less than 12 weeks prior to departure of any Digital Photography Holiday the full payment must be made for the particular holiday booked.
a ii)  Any one day or half day photography workshops held in the UK the balance is due 30 days before the commencement day of the workshop, we will send out an email reminder. If Digital Photography Holidays fail to receive the balance payment for the workshop we reserve the right to cancel this booking and retain the deposit payment.
b i)  Non-photography partner payment is due at the same time as the booked photography guest pays their deposit.
b ii.)  Please note that the non-photography partner payment only includes shared accommodation with a photography partner unless otherwise stated. 
b iii.)  Non-photography partners are included in all the daily photography location shoots.

3. Booking
a.)   Whether you book alone or as a group Digital Photography Holidays will only deal with the lead booking name in all subsequent correspondence, including changes, amendments and cancellations. You must be 18 years old at the time of booking and possess the legal capacity and authority to book as the lead name and travel on holidays. You are solely responsible for ensuring the accuracy of the personal details or any other information supplied in respect of yourself and any other person travelling on the booking and for passing on any information regarding the booking or any changes made in relation thereto, to all persons travelling on such booking, including but not limited to information on schedule changes or copies of booking confirmations.

b i.)  For all non-UK based photography holidays after the deposit and booking has been accepted by Digital Photography Holidays we will request your contact details, travel and camera insurance details (see clause 6), emergency contact details, passport details (for any internal flights that Digital Photography Holidays have to book as part of the holiday) flight arrival and departure times to the destination country of the holiday(s) booked and failure to supply the requested information by the date we have informed you by email will result in a
n administration charge of £35.
(Note: only your name(s) will be passed on to the hotel(s) that we will be staying in for the purpose of reserving a room - when checking in to any hotel we are staying in, the hotel will request any further information relevant to the countries laws or by laws and or the conditions of the hotel that we are staying in and you are responsible for supplying all required travel documents and visas and for complying with all laws, regulations, orders, demands requested as a condition of the hotel(s) checking in policy.)
b.ii) For all UK based photography workshops or holidays after the deposit and booking has been accepted by Digital Photography Holidays we will request your contact details. 
Failure to supply the requested information by the date we have informed you by email will result in an administration charge of £35.
b.iii)  Booking hotel rooms yourself prior to the holiday commencing date or after the departure date of the holiday. 
If you book a hotel room yourself, we do not provide the airport transfer as this is part of the hotel contract and we cannot guarantee the same style room, you might have to change rooms. If you make the hotel booking through Digital Photography Holidays we provide an airport transfer to pick you up from the airport if you arrive before the commencing date of the particular holiday or to take you to the airport from the hotel if you depart after the holiday commencing date.

4. Cancellation
a.) Cancelling your holiday or UK workshop.
     If you wish to cancel your booking after we have issued a receipt for the holiday we must receive the cancellation notice in writing as soon as possible, as the cancellation can only become effective from the date and time of receipt of the cancellation letter sent to Digital Photography Holidays. The deposit payment is 
non-refundable as in section 1:Deposit, above. 
For any non UK based photography holidays if a cancellation is made in the 12 week period prior to the commencement date of the holiday booked, Digital Photography Holidays shall retain the full payment, unless we can allocate the booked holiday to another person on any reserve list and only if the holiday or workshop is fully booked at the time of the commencement of the holiday or workshop, in which case the balance will be refunded less a £75 administration fee, the non-refundable deposit will be retained by Digital Photography Holidays. (see clause 1: Deposit above and clause 6:Insurance below)
a. ii) If you wish to cancel any UK based photography workshop after you have paid the full balance payment for the workshop booked, Digital Photography Holidays will retain the deposit and balance payment. (see clause 6 Insurance, below.)

b.i) Transferring your holiday to another date.
     If you wish to postpone your holiday and move it to another date, we must be informed in writing or email prior to the balance due date and if there is availability on another holiday the transfer arrangement is subject to a £75 administration fee.
b.ii) If Digital Photography Holidays cannot fill your place that you are transferring, or if that holiday or workshop is not full at the time of the holiday or workshop commencement date, then the deposit payment will be held on the original holiday or workshop that was booked, 
the non-refundable deposit will be retained by Digital Photography Holidays and will not be able to be transferred to a new date, (see clause 6 Insurance below). Digital Photography Holidays will inform you if we fill the place you are transferring and that the holiday is full on the commencement date of the holiday or workshop.
b iii)  Any transfer that is accepted by Digital Photography Holidays may only be used against an alternative holiday taken within 12 months of the original booked holiday. Should the deposit cost of the alternative holiday be less or more this will be taken against the final balance due. The £75 transfer fee is payable within 7 days of receipt of transfer confirmation.

c.) Cancellation of your holiday by Digital Photography Holidays.
    In the unlikely event that Digital Photography Holidays has to cancel your holiday we will inform you in writing. You will then have the choice of moving to another holiday and if the holiday is of a lesser cost then the refund of the difference will be made to you, or you can withdraw from the contract (see clause 6).
For the avoidance of doubt, as Digital Photography Holidays is not party to any flight bookings or any other travel arrangements you make yourself and has received no payment for the same, we will not refund the costs of your flight or any other travel costs incurred by yourself in the event of holiday cancellation by us, you are referred to clause 6 below.

d.) Force Majeure (events beyond our control)
     Digital Photography Holidays cannot be held responsible for the cancellation of a holiday due to events beyond our control (force majeure) including: war, threat of war, riots, civil disturbances, terrorist activity and its consequences, industrial disputes, natural and nuclear disasters, fire, epidemics, health risks and pandemics, unavoidable and unforeseeable technical problems with transport for reasons beyond our control or that of our suppliers; closed or congested airports or ports, acts of God such as hurricanes and other actual or potential severe weather conditions, and any other similar events. Also should the foreign office advise against visiting one of our regions, we shall immediately take their advice and cancel holidays in line with their recommendations. Due to this situation being force majeure, meaning that even taking reasonable care we could not have prevented it from happening, we are unable to refund the cost of your holiday or pay compensation for your holiday cancellation. (We refer you to clause 6)

e.)  Digital Photography Holidays also reserve the right for any reason or at any time, at our sole discretion, to decline to accept or to retain any person on a holiday as a client particularly if their conduct is disruptive and affecting the enjoyment of other participants on the trip, and we shall be under no liability for any costs incurred by such a person as a result of our doing so. 

5.) Travel and flight bookings to the point of departure
     a.) As Digital Photography Holidays is not party to any flight bookings or any other travel arrangements you make yourself up to the commencement date of the holiday and has received no payment for the same, we will not refund the costs of your flight or other travel arrangements in the event of holiday cancellation. Please refer to clause 6 of the terms and conditions below.

b.) Flight booking to the destination and departure country of the holiday booked is the client’s responsibility and Digital Photography Holidays cannot be held responsible for any expenses, loss or other damage caused to you by the acts or omissions of the carrier. You are referred to clause 6 below.

c.) Airport transfers are provided free of charge for guests arriving on the day the holiday commences and the day the holiday finishes as seen in Digital Photography Holidays travel itinerary for the holiday booked.

d.) Guests arriving earlier than the holiday commencement date and departing after the day the holiday finishes as seen in the travel itinerary are not provided with a free airport transfer unless extra nights accommodation are booked through Digital Photography Holidays at their chosen hotel as seen in the travel itinerary for the holiday booked.

6.) Insurance
    It is a term of the contract between us that the client must obtain the appropriate travel insurance cover before you set out on the holiday whether it be from the UK or another departure country. The insurance must cover the loss, expenses and damages arising from, including but not limited to, the cancellation of the holiday (whether in whole or in part), including cancellation due to force majeure, personal accident and injury, medical and repatriation costs for overseas holidays, loss of baggage and personal money and belongings and flight cancellations and delays. We strongly recommend that you and all members of your party are adequately insured as soon as you book your holiday.

7.) Passport and Visas
     a.) All clients must hold a valid passport, with over 12 months validity before the date of expiry.

     b.) You are responsible for obtaining all required travel documents and visas and for complying with all laws, regulations, orders, demands and travel requirements of countries to be flown from, into or through which you transit and that you have obtained any necessary permits or certificates for the countries to be visited including any medical or vaccination certificates required by any countries to be visited or for any countries that require these whilst in transit for the whole duration of the journey.

c.) We shall not be liable for the consequences to any client resulting from his or her failure to obtain such documents or visas or to comply with such laws, regulations, orders, demands, requirements, rules or instructions.

8.) Transportation whilst on the holiday
a.)   If there are any internal flights included as part of the holiday then the baggage allowance for any internal flights paid for by Digital Photography Holidays will be notified to the client before departure of the holiday booked. If this baggage allowance is exceeded by the client then any additional excess baggage costs incurred will be the sole responsibility of the client.

b.)  We shall have no liability whatsoever for damage to articles not permitted to be contained in Checked Baggage under Article 8.c, including fragile or perishable items, items having a special value, such as money, jewellery, precious metals, computers, personal electronic devices, keys, negotiable papers, securities, or other valuables, business documents, passports and other identification documents, or samples. 

c.) ITEMS UNACCEPTABLE AS BAGGAGE
    i) You must not include in your Baggage:
    ii) items which are likely to endanger the aircraft or persons or property on board the aircraft, such as those specified in the International Civil Aviation Organisation (ICAO) Technical Instructions for the Safe Transport of Dangerous Goods by Air and the International Air Transport  Association (IATA) Dangerous Goods Regulations, and in our regulations;
    iii) items the carriage of which is prohibited by the applicable laws, regulations or orders of any state to be flown from or to; and
    iv) items which are reasonably considered by the airline to be unsuitable for carriage because they are dangerous, unsafe or by reason of their weight, size, shape or character, or which are fragile or perishable having regard to, among other things, the type of aircraft being used.
     v) Firearms and ammunition of any kind are prohibited from carriage as Baggage.
     vi) You must not include in Checked Baggage money, jewelry, precious metals, computers, personal electronic devices, negotiable papers, securities or other valuables, business documents, passports and other identification documents or samples or necessary medication.
     vii) If, despite being prohibited, any items referred to in Articles 8ci to 8cvi (inclusive) that are included in your baggage, we shall not be responsible for any loss or damage to such items. In addition, failure to comply with such requirements may result in severe criminal penalties being brought against you and you shall also be liable for any costs resulting from any disruption incurred by us as a result of you not complying with this requirement and we shall be entitled to refuse you carriage on any return or subsequent flight.

9. Alterations to holiday description
a.) The type of holidays we offer requires flexibility and must allow for alternatives. For this reason any outline itinerary and holiday description must be taken as an indication of what may take place on the holiday, and not as a contractual obligation on the part of Digital Photography Holidays.
b.) In the unlikely event that we become unable to provide a significant proportion of the services you have booked after you depart, we will make alternative arrangements for you at no extra charge, or if this is impossible, we will provide you with transport back to the point of departure from your holiday destination, and a pro rata refund for the cost of the remainder of your holiday.

10. Prices
We guarantee that the price of your holiday will not be subject to any surcharges once a booking has been confirmed.

11.) Complaints
The client must communicate any perceived failure in the performance of this contract on the spot to the tour leader thus giving the tour leader the opportunity to achieve a satisfactory solution. Should this not be possible, you should make your complaint known to us in writing within 28 days of the completion of the holiday.

12.) Your Responsibilities
a.)    Activity holidays can be hazardous. In the interests of safety you undertake to follow the advice of our representative, guide or hotelier, comply with any local codes of conduct, follow the country code and act sensibly and prudently at all times. You also agree to indemnify us from all loss and/or damage arising from any act of default on your part.

b.) It is your responsibility to advise us in writing, at the time of booking, of any medical or other ailment or allergy. We must also be notified of any special dietary requirement.  We will advise the relevant supplier of your requirements, but we cannot guarantee that such requests will be met, and will have no liability to you if such requests are not met.
c.) You are responsible for ensuring that the holiday you select is within your physical capabilities.
d.) Digital Photography Holidays cannot be held responsible for any fine or penalty you incur by reason of your failure to comply with laws, regulations, orders, demands or other travel requirements of the countries concerned or to produce the required documents.
 
13. Digital Photography Holidays does not accept responsibility or liability for death, bodily injury or illness caused to the client or any other person included on the booking form arising directly from participating on the holiday(s).

14. By paying the deposit and filling out and signing the booking form you are agreeing to accept the above terms and conditions. The client who signs the booking form does so on behalf of all the individuals included on it, so that all are bound by the above booking conditions.
